Terms of use
1. About these terms
These terms are the agreement between you and Sprell Limited (“we”, “us”), a company registered in England and Wales (company number 17509243), whose registered office is 225 Gray’s Inn Road, London WC1X 8RH, for using the Sprell app. By using Sprell you accept them. If you don’t, please don’t use the app.
Our privacy policy explains what happens to your information. Contact us at hello@sprell.app.
2. Who can use Sprell
You must be 16 or over. Sprell asks for the month and year you were born when you first open it, and it isn’t designed for anyone younger. If you’re under 18, Sprell doesn’t offer alcoholic drinks to log, and some of its privacy settings start on for you.
Sprell is for your own personal use, not for business or commercial purposes.
3. Using Sprell safely
- Drink responsibly. Sprell isn’t a drinking app or a measure of how much is safe for you. Water reminders and drink counts are a nudge, not health advice. The UK Chief Medical Officers advise not regularly drinking more than 14 units a week. For support, visit drinkaware.co.uk.
- Not health or safety advice. Nothing in Sprell is medical advice. Steps, distance, pace and reminders are estimates.
- Stay aware of where you are. Don’t use the app while driving or cycling, or anywhere looking at your phone isn’t safe.
- Location can be wrong. GPS can drift, drop out indoors or miss parts of a route. Don’t rely on Sprell to find your way or to know where someone is.
- Look after yourself and others. You are responsible for your own choices on an adventure, including any challenges you take on. Only do what’s legal, safe and agreed by everyone involved.
4. Acceptable use
You mustn’t:
- use Sprell to track, follow or watch another person without their knowledge and agreement;
- break the law while using it, or use it to harm, harass or embarrass anyone;
- copy, change, sell or redistribute the app, or try to get at its source code, except where the law allows;
- interfere with the services the app uses, for example by sending automated requests to our place lists or map services;
- remove or hide the OpenStreetMap credit or other notices.
If you break these rules we can stop supporting your use of the app, without affecting any rights the law gives you.
5. Your content
Your adventures, stops, notes and cards are yours. They stay on your phone, and we don’t claim any rights over them.
When you share a card, route or file, you choose who sees it. Before you share, check it doesn’t show anything you’d rather keep private, such as where you live or who you were with. Turn on Hide start and end when you make a card to leave the first and last 200 m of your route off it. Respect other people’s privacy, including the names you write in notes and stops.
Keep your own copies: if you lose or reset your phone, we can’t recover your adventures. Use Export history in History to keep a backup.
6. Our app, and the data and software it uses
We own Sprell, its name, design, avatar art and badges. We give you a personal, non-transferable licence to use the app on devices you own or control, under these terms.
Sprell uses information and software from others, under their licences:
- Places: from OpenStreetMap, © OpenStreetMap contributors, under the Open Database License.
- Map pictures: from Esri today. We’re replacing them with our own map, built from OpenStreetMap.
- Wordmark typeface: Comfortaa, under the SIL Open Font License.
- Open-source software: listed on our credits page.
Place names, opening details and map data come from these sources and can be out of date or wrong.
7. Availability and changes
Sprell is free. We may update it, change or remove features, or stop offering it. Maps and place suggestions depend on online services and may sometimes be unavailable; the rest of the app keeps working offline.
If we stop offering Sprell, we’ll give you reasonable notice where we can, so you can export your history.
8. Our responsibility to you
We make Sprell with reasonable care and skill. Because it’s free and relies on your phone, GPS and online services, we can’t promise it will always be accurate, available or free of errors.
We aren’t responsible for:
- losses we couldn’t reasonably have foreseen;
- loss of adventures you didn’t export, for example if your phone is lost, reset or replaced;
- decisions you make on an adventure, including what and how much you drink;
- what other people do with cards or files you share.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit. Your legal rights as a consumer aren’t affected.
9. Ending, changes and the law
- Stopping: you can stop using Sprell at any time by removing it from your phone.
- Changes to these terms: we’ll show the new date at the top, and tell you in the app before a significant change takes effect. If you keep using Sprell afterwards, the new terms apply.
- Law: these terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
- Problems: please contact us first at hello@sprell.app, and we’ll try to put things right.
- The rest stands: if a court finds part of these terms invalid, the rest still applies.
